When Can You File a Motion for New Trial?
Moving for a new trial can be the only hope in many cases. According to the Massachusetts rules of criminal procedure, you can make a motion for a “new trial at any time if it appears that justice may not have been done.” While every situation must be evaluated on its own merits, “justice may not have been done” in cases involving:
- Newly discovered evidence such as testimony, DNA evidence or other key evidence
- Legal errors at trial or incorrect rulings based on the law
- Injustice during the first trial such as racism, jury misconduct, ineffective assistance of counsel, or other violations of constitutional rights
